Intellectual Property Claims (Copyright Infringement (DMCA), Trademark)
Workeet takes the protection of intellectual property (IP) rights seriously and respects the intellectual property rights of third parties. To this end, we provide the necessary mechanisms for the protection of intellectual property rights.
Since the content uploaded to the Workeet platform by our users is User-Generated Content (UGC), we have created and implemented special processes for reporting intellectual property rights violations (copyright and trademark).
Once a report with all relevant information is received from a rights holder or authorized representative (“claimant”), we will remove or disable access to the content involved in:
- Copyright Infringement
- Trademark Infringement
Workeet reserves the right to request additional information from a claimant, such as proof of ownership or other documentation.
Services That Violate Intellectual Property Rights
In accordance with various laws—and our commitment to protecting the work of our creative community, Workeet does not allow any services that violate the intellectual property (IP) rights of individuals and/or companies and will take action against those who provide or request such services, thereby helping to protect our creative community.
Do not offer, agree to provide, or request services such as:
- Services related to copying or distributing copyrighted material (digital piracy), such as creating torrent sites, developing platforms for streaming movies and TV shows, selling access to any streaming service account, etc.
- Services involving hacked or cracked software products (programs, applications, themes, templates, games, etc.).
- Services aimed at intentionally removing watermarks or copyright marks without the consent or permission of the owner.
Workeet reserves the right to permanently suspend accounts involved in intellectual property rights violations.
Non-Original Design Standards
Workeet values the hard work and creativity of individuals. As a platform that supports designers, artists, writers, and creatives worldwide, it is essential that only original works are presented and delivered. We will take swift and serious action against any non-original work that is submitted and/or delivered as original work.
The following standards refer to service listings, portfolio projects, and delivered orders in the Graphic Design and Photography categories on Workeet:
- Do not portray, sell, or deliver the work of others as your own.
- Exclusive concept and publication: If working with existing creative elements, designers must implement these elements in a unique way to create a new design concept.
- The delivered work must be customized and unique, meaning the design should not have been previously published online or offline and must have been invented for the first time.
Service Images and Portfolio Projects
All designs or photographs displayed in Service images and portfolio projects must be the original work of the provider—however, they may be works previously published on the designer’s websites or social media. To use a design or photograph from a delivered order on Workeet, the designer must have the consent of the client who placed the order.
Elements That May Be Similar
- Generic shapes: e.g., dots, lines, squares, ellipsoids, cones, etc.
- Functional designs: e.g., a circle, a diamond, a heart, tiger ears, car wheels, the color green to convey environmental responsibility, etc.
Elements Not Eligible for Copyright Protection, Such As:
- Short phrases like “Carpe Diem” or “The Sun Will Shine Again.”
- Facts and theories such as scientific facts or Quantum theory.
- Abstract ideas, but not the way an idea is expressed. For example, the basic plot of a comic book may be an idea, but not the way the designer expressed that idea.
Stock Images and Templates Policy
Ensure you have all necessary licenses to use stock images or templates in your delivery.
- Stock Images: All stock images must be from authorized agencies. Do not deliver or publish stock images “as is.” Stock images may be used in a transformative manner as part of your delivery.
- Templates: If you start your design work with a template, ensure that the final delivered design is significantly different from the template design, with a new look, an exclusive concept, and/or transformative use. Freelancers who rely heavily on templates in their design work will not be eligible for special provider programs on Workeet, such as Workeet Pro.
Responsible Digital Creation
At Workeet, we are committed to fostering a community of responsible digital creators. Often, creations on Workeet may involve third-party services or products intended to be used by third-party platforms (e.g., social media networks, other online marketplaces, or AI-powered content creation services). In such cases, we ask our users to follow these guidelines:
- Respect for Third-Party Rights: Users must respect third-party rights, both within and outside the Workeet community. If you know that your activity or delivery on Workeet depends on other platforms or companies, follow their Terms of Service (ToS) and other relevant policies (e.g., their Privacy Policy or Intellectual Property Policy).
- Transparency: When using external elements, users must be transparent about the use of third-party content, including the rights they have to such content. Misrepresentation is strictly prohibited.
- Mutual Respect: Freelancers are encouraged to communicate transparently about the use of external elements in their creations, especially in Services. For clients requesting deliveries involving third parties, we recommend being proactive in understanding the origins of the elements integrated into order requirement discussions or other conversations with freelancers to ensure their order does not violate any rights.
Intellectual Property Protection
Users are expected to respect Intellectual Property (IP) rights, including copyright and trademark protections, even if the content is freely available, and to maintain a record when collaborating or using external content. Deliveries created on Workeet must not violate the intellectual property of others. When applicable, users must provide the relevant licenses or permissions to confer the necessary rights.
By adhering to these guidelines, users can contribute to a thriving digital environment and legal digital marketplace, ensuring that the creative process is based on legality, transparency, and mutual respect.
The Difference Between Incorporating Other Freelancers’ Work in Your Delivery and Profit Arbitrage
Other freelancers’ work may be used in your delivery when you have the right to use it and it is used as an element of your own delivery. It cannot be used as your own delivery when resold “as is” without significant added value or transformative use, under the misconception that it is your original work and for the purpose of profiting from price differences. This is called profit arbitrage and is not allowed on Workeet.
Examples of Other Freelancers’ Work You May Use (If You Have the Right to Reuse Them):
- Designs as backgrounds for video clips
- Images for websites or presentations
- Music arrangements for explainer videos
